NEW ENGLAND BOAT SHOW GIVEAWAY OFFICIAL RULES

(“OFFICIAL RULES”)

The “New England Boat Show Giveaway” (the “Giveaway”) is sponsored by the National Marine Manufacturers Association (“Sponsor”). This Giveaway is governed by these Official Rules. By participating in the Giveaway, each entrant agrees to abide by these Official Rules, including all eligibility requirements, and understands that the results of the Giveaway, as determined by the Sponsor and its agents, are final in all respects. The Giveaway is subject to all federal, state, and local laws and regulations and is void where prohibited by law.

1. ELIGIBILITY: Only persons 18 years and older at the time of entry, who are legal residents of Connecticut, Massachusetts, Maine, New Hampshire, Vermont, or Rhode Island are eligible to enter this Giveaway unless prohibited by law (“Entrant(s)”). This Giveaway is void where prohibited or restricted by law. Entrants may enter the Giveaway multiple times. Employees, officers, and directors of Sponsor (including, without limitation, its respective affiliates and subsidiaries), along with their immediate family members and/or those living in the same household of each such person, are not eligible to win the Giveaway. Participants residing in areas in which the Giveaway is void may participate in the Giveaway but not win the prize. 

2. HOW TO ENTER: There is no entry fee, and no purchase is necessary to enter or win this Giveaway. The Giveaway begins at 12:00PM CT on November 6th, 2023, and ends at 11:59PM EST on December 5th, 2023 (“Submission Period”). Entrants entering the Giveaway electronically will enter by liking the designated photo on the @DiscoverBoating Instagram page, tagging an active user in the comments of the designated photo, and following the @DiscoverBoating, @NEBoatShow, and @OmniBostonHotel Instagram accounts (the “Submission”). One entry per person, per day. All Submissions must be received during the Submission Period. Sponsor reserves the right to extend or shorten the Giveaway at its sole discretion.

3. SUBMISSION REQUIREMENTS: Submissions not in compliance with the submission requirements outlined in these Official Rules (as determined by Sponsor in its sole discretion) may not be considered.    

Submissions may not include profanity, obscenity or otherwise incorporate inappropriate themes or activities.  Submissions may not include, depict, or promote vandalism or property damage.  Submissions found, in Sponsor’s sole discretion, to be inappropriate, in poor taste, or to violate the Sponsor’s Bylaws or policies will be disqualified. 

Sponsor is not responsible for lost, late, unreadable, unqualified, or incomplete Submissions, or Submissions not received for any reason. Submissions will not be acknowledged. 

4. WINNER SELECTION: One winner will be chosen at random at the close of the Submission Period from all qualified Submissions. Submissions that do not comply with these Official Rules are subject to disqualification. The Sponsor’s decision regarding all matters of the Giveaway, including, without limitation, whether a Submission is qualified, will be final and binding and no discussions will be entered into with respect thereto. 

5. PRIZE DESCRIPTION: The winner will receive two (2) tickets to the Discover Boating New England Boat Show, 1-night stay at the Omni Boston Hotel, breakfast for two at Kestra, free valet parking for one night, $100 Levy Bucks vouchers, $250 gift card for Coquette, and Discover Boating merchandise (swag bag) (estimated value $1000) (the “Prize”). The Sponsor is not responsible for inaccurate Prize details supplied to any entrant by any third party connected with this Giveaway. No cash alternative to the Prize will be offered. The Prize is not transferable. The Prize is subject to availability and the Sponsor reserves the right to substitute any prize with another of equivalent value without giving notice. The Sponsor will notify the winner when and where the Prize can be collected. ALL TAXES ARE THE SOLE RESPONSIBILITY OF THE WINNER. The Prize is awarded without warranty, express or implied, of any kind. The winner’s name, image, and likeness may be included in Sponsor’s publications and posted on its website, Instagram and Facebook pages and via other forms of social media.

6. WINNER NOTIFICATION: The winner will be notified within 14 days after the end of the Submission Period. Inability to contact a winner may result in disqualification and selection of an alternate winner. If the winner cannot be contacted or does not claim the Prize within 14 days of notification or is not qualified to win, the Sponsor reserves the right to withdraw the Prize from the winner and choose a replacement winner.

7. CONDITIONS OF PARTICIPATION:

a. Entrants entering a Submission into the Giveaway warrant that they have permission to do so from all those tagged in the Submission, and Entrants relieve Sponsor and its respective subsidiaries and affiliates, of all liability.

b. As a condition of receiving the Prize, the winner will be required to execute and return a Certificate of Eligibility, Consent and General Release form within 14 days of notification. Noncompliance within this time period may result in disqualification and selection of an alternate winner.

c. No transfer, assignment, or substitution of the Prize permitted, except Sponsor reserves the right to substitute Prize (or prize components) for an item of equal or greater value at Sponsor’s sole discretion. 

d. All federal, state, and local laws and regulations apply. Entrants agree to be bound by the terms of these Official Rules and by the decisions of Sponsor, which are final and binding on all matters pertaining to this Giveaway. 

e. By entering and/or accepting the Prize, Entrants and the winner agrees to hold and indemnify Sponsor, and its respective subsidiaries and affiliates, promotional partners, directors, officers, and employees harmless for liability, damages, or claims for injury or loss to any person or property, relating to, in whole or in part, directly or indirectly, participation in this Giveaway, the acceptance and/or subsequent use or misuse or condition of the Prize awarded, or any claims including but not limited to claims based on publicity rights, defamation, invasion of privacy, or copyright infringement. False or deceptive entries or acts will render the Entrant ineligible. Sponsor, in its sole discretion, reserves the immediate and unrestricted right to disqualify any Entrant or the Prize winner, if either commits or has committed any act or has been involved or becomes involved in any situation or occurrence which the Sponsor deems likely to subject the Sponsor, Entrant, or winner to ridicule, scandal, or contempt or which reflects unfavorably upon the Sponsor in any way. If such information is discovered by Sponsor after a winner has received notice of winning and before the Prize is awarded, Sponsor may rescind the Prize in its entirety. If a portion of the Prize has already been awarded, Sponsor may withdraw the remainder of the Prize that has been fulfilled. Decisions of the Sponsor are final and binding in all matters related to this paragraph. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Giveaway, or in the announcement of the Prize. 

8. NOT ENDORSED BY INSTAGRAM: By participating in this Giveaway, Entrant acknowledges that this Giveaway is in no way sponsored, endorsed or administered by, or associated with Instagram and releases Instagram from any and all liability arising from or related to this Giveaway. The information you are providing for this Giveaway is being provided to the Sponsor and not to Instagram and will be used to notify you if you have won, and to inform you about special offers from the Sponsor and/or its trusted partners, affiliates, exhibitors, and sponsors.

9. CONDUCT: All Entrants agree to be bound by these Official Rules. Sponsor, in its sole discretion, reserves the right to disqualify any person they find to be tampering with the entry process or operation of the Giveaway website or that they find has otherwise violated these rules.

10. LIMITATIONS OF LIABILITY: Sponsor is not responsible for lost or late Submissions nor for electronic-transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone-equipment, electronic, computer, hardware, or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by Sponsor or presenter on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof. If for any reason the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Giveaway, the Sponsor reserves the right at its sole discretion to disqualify any individual who tampers with the entry process and to cancel, terminate, modify, or suspend the Giveaway. Sponsor reserves the right to select a winner from eligible entries received as of the termination date. CAUTION: Any attempt by an Entrant to deliberately damage any website, Sponsor’s intranet or undermine the legitimate operation of the Giveaway is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such Entrant to the fullest extent of the law. If there is a dispute as to the identity of the Entrant, the Prize will be awarded to the authorized account holder of the e-mail address. The “authorized account holder” is defined as the natural person to whom the e-mail address is assigned.

11. GOVERNING LAW: This Giveaway is governed by the laws of the State of Illinois, without regard to principles of conflict of laws. All cases and claims pertaining to this Giveaway must be brought in a court of competent jurisdiction in Chicago, Illinois, without recourse to class-action suits. 

12. SEVERABILITY: If any provision of these Official Rules is found to be invalid or unenforceable by a court of competent jurisdiction or appointed arbitrator, such determination shall in no way affect the validity or enforceability of any other provision herein. 

13. WINNER LIST: The name of the winner can be obtained by sending a self‐addressed stamped envelope to Discover Boating, ATTN: Social Media Team, 10 S LaSalle St, Chicago, IL 60603
